A motion to disqualify Attorney David Lujan as Mark Smith's legal counsel has also been denied.

Guam - Attorneys for former Guam Housing and Urban Renewal Authority legal counsel Mark Smith and his friend Glenn Wong will be pushing for a trial date of June 6, which is less than three weeks away.

Smith’s attorney David Lujan noted this in court papers today after Chief Judge Ramona Manglona denied a motion filed by the US Attorney’s office to disqualify Lujan as Smith’s attorney.

Smith and Wong are facing Section 8 housing fraud charges that were filed against them just two months ago. Smith served as GHURA’s legal counsel while he was also a section 8 landlord.

After the conflict of interest was revealed, Smith transferred ownership of his properties to Wong but federal authorities believe Smith continued to benefit from the section 8 program under the table./

Lujan is pushing for a June 6 trial start date as his client has asserted his right to a speedy trial.
