VIDEO: CNMI Judge Weisman Rejects Buckingham's Bail Application Because Former AG Is Not Yet in Custody

Guam - Superior Court Associate Judge David Wiseman has rejected the $50,000 bail application by former Attorney General Edward Buckingham.


Buckingham is wanted in the CNMI on numerous felony charges and is believed to be in hiding in the U.S. state of Iowa.

Wiseman said granting bail when a defendant is not in custody is not something that can be found in any CNMI statute.

The Saipan Tribune also reports that Judge Wiseman ruled that since Buckingham is a fugitive from justice, he is subject to the fugitive disentitlement doctrine previously set forth by the Superior Court and approved by the CNMI Supreme Court.

The judge said when a defendant wants to be released from custody, he or she may post the bail set and a date will be given to them for their next appearance in court.
